第1条（適用）

本規約は、StellaDear（以下、「当方」といいます）が提供するスマートフォン向けアプリケーション「Memoria」（以下、「本アプリ」といいます）の利用条件を定めるものです。ユーザーは本規約に同意の上、本アプリを利用するものとします。

第2条（対象年齢）

本アプリはAIキャラクターとの親密な対話を含むサービスです。17歳以上を対象としています。17歳未満の方のご利用はお断りします。

第3条（AI生成コンテンツに関する免責）

本アプリは、人工知能（AI）技術を用いてキャラクターとの対話および付随する機能（カレンダーへのコメント等）を提供します。

AIによる出力内容（発言、提案、予定に関する助言等）は、その正確性、完全性、妥当性、または特定の目的への適合性を保証するものではありません。

AIの出力に基づきユーザーが行った一切の行為、およびそれにより生じた損害について、当方は何ら責任を負わないものとします。

第4条（データの管理と免責）

本アプリにおけるキャラクターの記憶データ、会話ログ、およびカレンダー情報（以下、「ユーザーデータ」といいます）は、当方の指定するクラウドサーバー上に保存されます。

当方は、システムメンテナンス、予期せぬ障害、その他の理由によりユーザーデータが破損または消失した場合、一切の復旧義務および損害賠償責任を負わないものとします。

ユーザーは、本アプリ内の退会機能を利用してアカウントを削除した場合、蓄積されたすべてのユーザーデータが物理的に即時削除され、いかなる理由があっても復元できないことに同意するものとします。

第5条（有料サービス）

本アプリ内の一部機能は、有料にて提供されます。サブスクリプションプランはパートナー ¥1,280/月（税込）、ファミリー ¥1,980/月（税込）、プレミアム ¥4,800/月（税込）の3種類、および都度課金のエネルギー補充パック ¥500（1回、税込）があります。

有料プランの決済および解約手続きは、Apple Inc.またはGoogle Inc.の提供するプラットフォーム決済システムを介して行われます。当方は決済に関する直接の責任を負いません。

第6条（禁止事項）

ユーザーは以下の行為を行ってはなりません。

  • 本アプリを違法な目的に使用すること
  • 本アプリのシステムに不正アクセスすること
  • 他のユーザーまたは第三者の権利を侵害する行為
  • 第三者の著作権、肖像権、パブリシティ権その他の権利を侵害する画像、または公序良俗に反する画像を本アプリに設定・アップロードする行為
  • 本アプリの運営を妨害する行為

前項に違反してユーザーが設定・アップロードした画像その他のコンテンツに起因して第三者との間で紛争が生じた場合、ユーザーは自己の責任と費用においてこれを解決するものとし、当方は一切の責任を負いません。

第7条（規約の変更）

当方は、必要と判断した場合、本規約を変更することがあります。変更後の規約は本アプリ内またはウェブサイト上での公表をもって効力を生じるものとします。

Article 1 (Scope)

These Terms of Service ("Terms") govern your use of the smartphone application "Memoria" ("the App") provided by StellaDear ("we" or "us"). By using the App, you agree to these Terms.

Article 2 (Age Requirement)

The App includes intimate conversational interactions with AI characters. The App is intended for users aged 17 and older. Users under the age of 17 are not permitted to use the App.

Article 3 (Disclaimer for AI-Generated Content)

The App uses artificial intelligence (AI) technology to provide character interactions and related features (such as calendar comments).

We make no warranties regarding the accuracy, completeness, suitability, or fitness for any particular purpose of any content generated by the AI (including statements, suggestions, or schedule-related advice).

We accept no responsibility for any actions taken by users based on AI-generated content, or for any damages arising therefrom.

Article 4 (Data Management and Disclaimer)

Character memory data, conversation logs, and calendar information (collectively, "User Data") are stored on cloud servers designated by us.

We bear no obligation to restore User Data and no liability for damages in the event that User Data is corrupted or lost due to system maintenance, unexpected failures, or any other reason.

By deleting their account using the in-app withdrawal function, users agree that all accumulated User Data will be immediately and permanently deleted and cannot be recovered for any reason.

Article 5 (Paid Services)

Some features of the App are provided on a paid basis. Subscription plans include Partner at ¥1,280/month, Family at ¥1,980/month, and Premium at ¥4,800/month (all tax included). A one-time Energy Refill Pack is also available at ¥500 (tax included).

Payment and cancellation procedures for paid plans are handled through the platform payment systems provided by Apple Inc. or Google Inc. We bear no direct responsibility for payment processing.

Article 6 (Prohibited Conduct)

Users must not engage in any of the following:

  • Using the App for illegal purposes
  • Unauthorized access to the App's systems
  • Actions that infringe upon the rights of other users or third parties
  • Setting or uploading images that infringe upon third-party copyrights, portrait rights, publicity rights, or other rights, or images that are offensive to public order and morals
  • Actions that interfere with the operation of the App

If any dispute arises with a third party due to images or other content set or uploaded by a user in violation of the preceding paragraph, the user shall resolve such dispute at their own responsibility and expense, and we shall bear no liability whatsoever.

Article 7 (Changes to Terms)

We reserve the right to modify these Terms when deemed necessary. Updated Terms will take effect upon publication within the App or on our website.
